Terms of Service:

The following are the Terms of Service for use of the RDS services. All users of this service are bound by these Terms of Service and we recommend it to be read carefully.

Amendment of Terms:

RDS reserves the right to change these terms and conditions of use at any time and those changes shall take effect in respect of all subsequent uses by you of the website. You should therefore check these terms every time before you use the website and only if you accept these terms should you proceed to access and use the software tool in the website.

The use of RDS Services:

RDS website provides software tool intended for use by any individual who is curious about the working of random number sequences. The nature of this software is that it is not suitable to be used for illegal purposes or any activities against the law of the country. Any user should refrain from using this software if continued use of it shows signs of detrimental effect on mental health to the users.

Pre Condition To Use:

Do not use this RDS services unless you have read these terms, and accept that they will govern your right to use and access our website and all the documents, links and information contained on it. If you choose to use RDS services, RDS will regard that use as conclusive evidence of your agreement and acceptance that these terms govern yours and RDS's rights and obligations to each other.

Membership:

To apply for an account, the applicant must submit the registration form with accurate, current and complete information. After the acceptance of the application, the new member will be assigned an account name and password. It is the responsibility of the member to maintain the confidentiality of the account and password, and all activities that occur under that account or password. It is agreed that in the case of unauthorized use of the account or any other breach of security that RDS is immediately notified.

Member Private Policy:

RDS respects the privacy of its members and will not monitor or disclose any private e-mail message or personal information without its member's prior permission, unless required by law, regulation, court order, or legitimate administrative purposes.

Private Users Only:

RDS has been designed and created for the purpose of research and entertainment and access is restricted to selected users. It has not been designed or created for public access.

RDS allows all users a personal, non-transferable and non-exclusive right and licence to use the content on a single computer. However, users may not (or allow any third party) to modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way the content available through the service and its associated Web sites.

Jurisdiction:

This agreement and this website are subject to the laws of countries in use and any applicable state. If there is a dispute between you and RDS that results in litigation then you submit to the jurisdiction of the relevant courts of the particular countries or the relevant state.

Trademarks and Restriction of Use:

You are not permitted to use any trademarks, trade names, graphics or designs that are on RDS website. If you breach RDS’s trade marks then RDS reserve the right to take action against you.

Proprietary Rights:

The user acknowledges and agrees that the content of the service may be protected by copyrights, trademarks, service marks, patents or other proprietary laws.

Exclusion of USERS:

RDS reserves the right to exclude and not permit any person from using its website and software tool.

Termination:

RDS reserves the right to suspend access to any account or password at its discretion with or without notice to the user. If, in RDS's reasonable opinion, the user breaches the terms or conditions, the user may lose access to the service.

Limitation Of Liability:

RDS will not be liable in any way for any loss or damage suffered by any member through the use of the service. RDS does not warrant that the service will be uninterrupted or error free, that defects will be corrected, or that the service or the server that makes it available are free of viruses or other harmful components. There is no warrant that information made available in the service will be correct, timely, accurate, suitable or reliable. Any use of such information is at the member's own risk.

Indemnification:

All members agree to indemnify and hold RDS, affiliates, officers, and other partners from any claim, demand or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the service.

Cap Plan Credit Card Details:

Credit Card Details for Cap Plan users are stored on our secure servers for the purposes of charging the weekly Cap Plan fee. Upon cessation of your Cap Plan all details will be deleted and no longer stored.

RDS Cap Plan Contract:

The below terms are only applicable to you if you enter into a RDS Cap Plan. They are in addition to those terms above.

A Cap Plan Contract is formed once you agree to these terms and conditions and your first payment is received by RDS. All Cap Plan Contracts run for a minimum of 12 months and continue until you request a Cancellation.

Pricing: All Cap Plan prices are shown in Australian dollars ($AUD) and do not include 10% GST. Cap Plan payments must be received in Australian currency. We reserve the right to amend our Cap Plan prices from time to time. Users outside Australia are not required to pay the 10% GST.

Payment: Payment of your RDS Cap Plan is due weekly or monthly, dependent on your RDS plan. If the payment method for your RDS account is by credit or debit card and payment is not received by RDS from the card issuer or its agents, you agree to pay all amounts due upon demand by RDS. Each time you use RDS services, or allow or cause RDS services to be used, you agree and reaffirm that RDS is authorized to charge your designated card. Your card issuer’s agreement governs your use of your designated card in connection with RDS, and you must refer to such agreement (not this Agreement) with respect to your rights and liabilities as a cardholder.

Cancellation: If you enter into a RDS Cap Plan, and chose to cancel the Cap Plan within 12 months of commencement and if the amount of payments through RDS cap plan exceeds the amount of time you have completed and decided on cancellation we agree to refund the remaining service time in retail prices.

If you enter into a RDS Cap Plan, and chose to cancel the Cap Plan after 12 months of commencement no additional payments apply and your Cap Plan will be ended at the end of the payment period on which notification was received by RDS two weeks before date of cancellation.

Conflicting Conditions: Where there is a conflict between RDS’s standard Terms and Conditions and the Cap Plan Terms and Conditions, the Cap Plan Terms and Conditions will apply.
